REPORT - Mr. Shabeel Ummer addresses students of JSS PS on Intellectual Property Rights

On the 16Th of March, the grade 12 students had gathered in our school auditorium for an interactive session with Mr. Shabeel Ummer as one of the activities of our project that is in affiliation with the Dubai Customs.

Mr. Shabeel studies law at Vishweswarapura College of Law in Bangalore, Karnataka. He attained his secondary education from ICA English Higher Secondary School in Kerala, India. He has written a book titled “Me and My Loneliness Often Speak”. Mr. Shabeel is a very experienced lawyer.

 He visited our school to explain to the students about copyright and trademarks.
It was very helpful to the students, because they were to be taught the importance of IPR and how IPR is present in our everyday lives.
He explained in what ways copyrights and trademarks are being violated without any deliberation in the field of cultural arts and how this can be stopped and avoided.  

This event was extremely informative to the students of grade 12 as they had little or no prior knowledge in the respective topic and also this information is very essential to the youth.


REPORT - IP Ambassador of JSS PS along with the team create awareness to students of JSS PS

On Wednesday 15th march, our group had made a presentation to the students of grade 12. This presentation was a briefing of what Intellectual Property is and all the laws relating to this particular top. The students were familiarized with our topic and awareness was spread regarding the same. There were about 80 students who attended this talk. The topics covered were:-
   Ø We started with a brief introduction to Intellectual Property Rights.
   Ø Then we moved on to talk about the exact meaning IPR along with a few relevant examples regarding the same.
   Ø We then introduced the topic of Copyrights to the students.
   Ø The students were then introduced to the topic of Trademarks
   Ø A very common mistake made by everyone is that they cannot differentiate between Copyright and Trademarks. This difference was explained to them along with relevant examples to make them further understand the topic better.
   Ø The last topic was the Infringement of copyrights and what is the consequence of doing the same.
All these topics helped the students get familiarized with what exactly IPR is. As the first activity of our awareness campaign, this event was a great success.

ESTABLISHING GOVERNMENT BODIES TO IMPOSE LAWS ON CULTURAL ARTS:

Governments should establish legal bodies that impose laws and ensure the functioning of the imposed laws. Assuming high efficiency, breaches of copyright will be brought down and establishing unique identity to artworks can be done with ease. 
=> Such a solution will reduce crime relating to copyright infringement at the same time motivating upcoming artists.


REDUCING EXPENSE OF COPYRIGHT LAWSUITS:

Filing lawsuits and continuation of trials should be made less expensive. Assuming a less expensive process is in place, the parties with minimum financial capabilities can fight for the protection of their works and the right to Intellectual Property without financial pressure.
=> Such a solution will motivate those artists who are not financially well off to pursue their trial.


SELECTIVE CENSORSHIP:

Censorship of artwork must be neither too strict nor too lenient. Assuming a selective censorship process is in place, misinterpretation of culture can be avoided. 
=> Such a solution will help establishing the identity of the country involved without hampering development of arts.


PROMOTION OF CULTURAL ARTS INTERNATIONALLY:

Cultural arts should be showcased extensively in International media to promote tourism and developing identity of the country, cultural arts represent a country and hence should be used as a tool for developing the cultural identity of a country internationally. Assuming the prevalence of cultural arts in international media, could allow potential markets abroad. This could be a source of income for the country in the form of royalties or profit. 
=> Such a solution will help establishing culture of the country and motivating upcoming artists and potentially adding to the income of the country.

General Problems

Cultural arts act as a method of interpreting culture of a country, its traditions and the perspective of the artists; this cannot be blatantly copied but only interpreted.

Paintings, literature and reinterpretation of folklore (dances/songs) visually showcase the artist’s perspective but this may not be the same way the audience and the government of the country interpret the artwork.

Problems arise when there is a conflict in practicing rights.

The artists may argue on their right to create whereas the original copyright holder does not recognize such nuances of artistic intent.

Filing suits tend to be expensive due to which minor breaches are neglected and major breaches are fought only by the wealthiest of the society.

This problem exacerbates with the fast pace of development and new innovation.

Legal systems of many countries tend to fall back on imposing laws that keep in pace with the technological advancement.

Plagiarizing work of arts has become very common and this may lead to decay of the cultural aspect of a country, thus, losing its originality.

Cultural arts are also at threat of breach of copyright out of the country since there is no standard, internationally accepted law in place to protect it.

There is a prevailing problem in reinterpretation of cultural arts, as the cultural identity may be lost in the process.

Intellectual Property And Its Importance

Human Beings are blessed with creativity and abundant resources from Mother Earth, both physical and biological.

This creativity helps human to employ these resources in a very unique way which significantly boosts the development process of the time period. These articles created by man is unique in - how it looks, how it is made and how it is employed.

In the early days, these articles fell into public domain and hence, were considered as a common property.

This resulted in the development of Intellectual Property, which protects inventions,creations and discoveries. Intellectual Property is pervasive since everything that humans are exposed to, is an Intellectual Property of somebody.

Intellectual Property is required to provide due recognition and incentives to the original creator and reduce the chance of work being exploited from other parties.
It also allows financial returns for the creator which motivates creators to come up with more products.

Intellectual Property also allows the presence of original and genuine products in the market for consumer consumption. Intellectual Property reduces the chance of potential infringement, such as counterfeiting, piracy etc.

Since everything a man uses for day to day activity is an Intellectual Property of somebody, these articles are protected by strong laws in all countries. Violation of these laws can result in serious punishments.

Therefore, it is important to know about Intellectual Property to not only protect products but also to refrain from violation.
